Terms of Service

Scope

Tidy Tiger LLC is the proprietor and operator of this service. The terms "we," "our," "us," and "Tidy Tiger" within these Terms of Service refer exclusively to Tidy Tiger LLC.

The provision of Tidy Tiger and additional offerings by Tidy Tiger LLC to you is governed by these Terms of Service ("TOS"), which are subject to change by us without prior notice. Your use of specific services by Tidy Tiger LLC is also governed by any guidelines or rules pertinent to those services, which may be issued occasionally. These guidelines or rules are considered an integral part of the TOS. Furthermore, for certain services, Tidy Tiger LLC may introduce Terms of Service that supersede these TOS. You are responsible for reviewing the TOS regularly. If the TOS are not acceptable or clear to you, you should refrain from using any services provided by Tidy Tiger LLC.

The TOS are binding for both "Affiliates" (entities or individuals who receive the Service for redistribution or republishing on third-party websites not owned by Tidy Tiger LLC) and "Users" (all individuals, including Affiliates, who utilize the Service in any form). Tidy Tiger LLC currently offers various resources to Affiliates and Users, which include services related to email. Any new resources that augment the existing Service will be governed by the TOS unless explicitly stated otherwise. By using the Service, you acknowledge and consent to the Service being provided on an "as is" basis, and that Tidy Tiger LLC is not liable for any delays, failure to deliver, deletion, or failure in storing any user communications or settings for personalization.

Provide Accurate Information

As a condition of your engagement with the Service, you commit to: (a) submitting truthful, precise, up-to-date, and complete details about yourself as indicated by the registration process of the Service ("Registration Data"), and (b) routinely amending the Registration Data to ensure it remains accurate, precise, up-to-date, and complete. Should any information you provide be found false, incorrect, outdated, or incomplete, or should Tidy Tiger LLC have justifiable reason to doubt the veracity, accuracy, currency, or completeness of the information, Tidy Tiger LLC reserves the right to suspend or terminate your account and deny any or all current or future use of the Service (or any portion of it).

Following the completion of the registration procedure for some Services, you may receive a password and account designation. You are tasked with safeguarding the secrecy of the password and account and are solely responsible for all actions that occur under your password or account. You agree to: (a) promptly inform Tidy Tiger LLC of any unauthorized use of your password or account or any other breach of security, and (b) make certain that you log out from your account at the conclusion of each session. Tidy Tiger LLC will not be held accountable for any loss or damage resulting from your non-compliance with this section.

Content

You acknowledge that any and all information, data, text, software, music, sound, images, graphics, videos, messages, or other materials ("Content"), whether shared publicly or transmitted privately, rests solely with the individual from whom such Content originated. This implies that you, not Tidy Tiger LLC, bear full responsibility for the Content that you upload, post, email, or otherwise disseminate through the Service.

Tidy Tiger LLC does not oversee the Content made available via the Service and, therefore, cannot vouch for its accuracy, integrity, or quality. While using the Service, you might encounter Content that could be deemed offensive, indecent, or objectionable. Tidy Tiger LLC will not be held accountable in any manner for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or harm of any kind that may occur as a result of your use of any Content posted, emailed, or otherwise shared through the Service.

Tidy Tiger LLC and its representatives reserve the right (but not the obligation) to reject or relocate any Content available through the Service. Furthermore, Tidy Tiger LLC and its designees may remove any Content that contravenes the TOS or is otherwise deemed unsuitable. You accept the responsibility of evaluating and bearing all risks associated with the use of any Content, including reliance on the accuracy, completeness, or utility of such Content.

Disclosure of Content

You acknowledge that Tidy Tiger LLC reserves the right to store Content and, if legally mandated, to disclose Content when such action is believed in good faith to be necessary for the purposes of (a) adhering to legal proceedings; (b) enforcing the TOS; (c) addressing claims that any Content infringes on the rights of third-parties; or (d) safeguarding the rights, property, or personal safety of Tidy Tiger LLC, its users, and the general public.

Access to the Service

Tidy Tiger LLC provides you with a personal, non-transferable, and exclusive right and license to operate its Software in object code form on a single computer, under the condition that you do not, nor do you permit others to, copy, modify, create derivative works from, reverse engineer, disassemble, or otherwise attempt to extract any source code, sell, assign, sublicense, secure an interest in, or in any way convey any rights in the Software. You commit to accessing the Service solely through the interface provided by Tidy Tiger LLC specifically for accessing the Service.

Third Parties

Your interactions or commercial engagements with advertisers encountered on or through the Service are entirely between you and the respective advertiser. Tidy Tiger LLC will not be held accountable for any loss or damage incurred as a result of any such transactions.

The Service or third parties may furnish links to other websites or resources. Since Tidy Tiger LLC does not exercise control over such external sites and resources, you acknowledge and agree that Tidy Tiger LLC is not accountable for the availability of such external sites or resources, and does not endorse, nor is it liable for, any Content, advertising, products, or other materials present on or available from such sites or resources.

Protected Materials

You recognize and concur that the Service, along with any necessary software utilized in conjunction with the Service ("Software"), comprises proprietary and confidential information safeguarded by relevant intellectual property and other laws. You agree not to alter, rent, lease, lend, sell, distribute, or generate derivative works based on the Service or the Software without explicit permission from Tidy Tiger LLC.

Abuse and Disallowed Names

You agree that you will not utilize the Service to:

• Transmit illegal, harmful, or abusive Content.
• Misrepresent your identity.
• Violate intellectual property rights.
• Send spam or unauthorized commercial communication.
• Disrupt the Service or transmit viruses.
• Violate any applicable laws.

Additionally, when choosing a username, you agree not to impersonate someone else, infringe on trademarks, or engage in "squatting."

Refund Policy

Your subscription to Tidy Tiger will remain active unless you decide to cancel it or we terminate your account. To prevent your credit card from being charged for the next cycle, you must cancel your subscription before the renewal date.

All paid plans with Tidy Tiger are prepaid and non-refundable. Tidy Tiger does not offer refunds or credits for any partial subscription periods. You are free to cancel your subscription at any time, with the cancellation taking immediate effect.

Limitations of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

• You use the Service at your exclusive risk. It is provided without warranties of any kind and on an "as available" basis.
• Tidy Tiger LLC does not promise that the Service will meet your needs, be uninterrupted, or error-free.
• You assume full responsibility for any damage or data loss.
• Tidy Tiger LLC will not be liable for indirect or consequential damages.
• Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some disclaimers may not apply.

Miscellaneous

The Terms of Service (TOS) are the comprehensive agreement between you and Tidy Tiger LLC. The laws of the Commonwealth of Massachusetts govern the TOS and your relationship with Tidy Tiger LLC. Both parties submit to the exclusive jurisdiction of the courts within Massachusetts for any disputes arising under the TOS.
